The question presented in this case is whether the trial Judge properly dismissed the information filed against Jessie G. Ziegenhagen on the grounds that he had been denied the constitutional right to speedy trial when the delay of twenty-four months between arraignment and trial was occasioned by the negligence of the state and under circumstances showing that the defendants witnesses, because of the delay, were either unavailable or unable to recall with clarity the incidents that led to the charge. We conclude that Ziegenhagen was denied his constitutional right to speedy trial and affirm the trial courts order dismissing the complaint and information.
